By accessing or using Meldry, you agree to these Terms. If you use Meldry on behalf of an organization, you represent that you have authority to bind that organization. If you do not agree, do not use the service.
1. The service
Meldry provides three AI-assisted image workflows: standard image creation, face swap, and product mockup. The service can prepare structured prompts, generate images, export prompt and image files, retain recent versions within the browser tab, and request follow-up edits.
Meldry depends on OpenAI services and an eligible ChatGPT account you authorize. Model access, usage limits, response times, and output availability may vary by account and are not controlled by Meldry.
2. Eligibility and account security
You must meet the minimum age required to enter a binding contract where you live and comply with the terms applicable to your ChatGPT account. You are responsible for activity performed through the session you connect, for keeping your devices secure, and for disconnecting a session you no longer control.
3. Your inputs and permissions
You retain your rights in briefs, reference images, logos, and other materials you submit (“Inputs”). You grant Meldry a limited, worldwide license to process Inputs only as needed to provide, secure, and troubleshoot the service. When you voluntarily submit feedback, the license also covers using that feedback to improve the service.
You represent that you own or have all permissions required for your Inputs and requested edits. For face swap, you must have permission to use the depicted person’s likeness. The in-product confirmation is a safety checkpoint, not a substitute for legal consent.
4. Acceptable use
You may not use Meldry to:
- Violate law, another person’s rights, or applicable OpenAI policies.
- Create deceptive impersonation, non-consensual intimate imagery, harassment, exploitation, or fraud.
- Use a person’s likeness without the authorization required by law.
- Infringe copyright, trademark, publicity, privacy, or other rights.
- Generate or distribute malware, credentials, or instructions intended to compromise systems.
- Probe, bypass, overload, scrape, resell, or interfere with the service or its security controls.
- Misrepresent AI-generated material as verified evidence or authentic documentation.
We may restrict access, preserve relevant records, or cooperate with lawful authorities when we reasonably believe these Terms or safety requirements have been violated.
5. Outputs and review
Subject to applicable law and third-party terms, you may use outputs generated for you. AI output can be inaccurate, similar to output produced for others, or contain unwanted visual details. Meldry does not guarantee uniqueness, ownership, non-infringement, factual accuracy, or suitability for a particular commercial use.
You are responsible for reviewing outputs before publication, disclosure, sale, or use in a consequential context. Logo and identity locks improve continuity but cannot guarantee perfect reproduction.
6. Intellectual property in Meldry
Meldry’s software, interface, brand, documentation, and original content are protected by intellectual-property law. These Terms grant you a limited, revocable, non-exclusive right to access the service for its intended purpose. They do not grant the right to copy, sublicense, reverse engineer, or create a competing service from protected Meldry materials, except where law expressly permits it.
7. Fees and third-party services
Meldry launch access is currently offered without a separate Meldry fee. Your OpenAI plan, usage eligibility, and any OpenAI charges remain your responsibility. We may introduce paid features later, but will disclose applicable pricing before charging you.
Third-party services, including OpenAI, are governed by their own terms. Meldry is not responsible for third-party changes, outages, account actions, or content practices.
8. Availability and changes
The service is provided on an “as available” basis. We may change, suspend, or discontinue a feature to address safety, security, provider availability, legal requirements, or product evolution. We do not promise uninterrupted access or permanent retention of browser-side render history.
9. Disclaimers
To the maximum extent permitted by law, Meldry is provided “as is” without warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, or that every output will meet your expectations. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.
10. Limitation of liability
To the maximum extent permitted by law, Meldry and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, data, goodwill, or business opportunities; or reliance on an AI output. Where liability cannot be excluded, our aggregate liability relating to the service will not exceed the greater of the amount you paid Meldry in the previous twelve months or US $100, subject to rights that cannot be limited by law.
11. Indemnity
To the extent permitted by law, you will defend and indemnify Meldry and its operators against third-party claims arising from your Inputs, your use of outputs, your violation of these Terms, or your infringement of another person’s rights.
12. Governing law and disputes
Except where mandatory consumer law requires otherwise, these Terms are governed by the laws of India, without regard to conflict-of-law rules. Courts with jurisdiction in Bengaluru, Karnataka will have exclusive jurisdiction. Before filing a claim, each party will make a reasonable effort to resolve the dispute by written notice.
13. General terms
If one provision is unenforceable, the remainder stays effective. A failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a reorganization or service transfer. These Terms and the Privacy Policy form the entire agreement about Meldry.
